SCF Arizona Drug and Alcohol Clarification

Recently many questions have been asked about Municipality / Governmental entities eligibility to participate in the drug and alcohol premium credit program. The attached is clarification from NCCI about the applicable statutes as they apply to Municipality / Governmental entities. In summary, to be eligible for the 5 percent discount to be applied to such entities policy, all employees must be eligible for testing. It is our understanding that most of these entities have restrictions around testing all their employees and therefore are unlikely to be eligible. Please carefully review this important communication and pass it along to any of your members in this category.

The Heat
Is On

Triple-digit temperatures are here.  It’s time to take precautions to avoid heat-related illnesses.

Staying hydrated is the first and most important step. The average
worker can lose up to three gallons of perspiration during a typical day shift. To offset this loss, the National Institute of Occupational Health and Safety suggests that workers drink five to seven ounces of fluids every 15 to 20 minutes and to avoid drinking caffeinated or alcoholic drinks, which cause dehydration.

Workers also should avoid strenuous activity during the hottest part of the day, and they should protect themselves from
the heat.

If you must work outside in the heat, take these precautions: Wear lightweight and light-colored clothing. Wearing a hat or using an umbrella adds protection. But remember, heat illnesses can occur despite the best preparation, so knowing their symptoms is essential. Heat illnesses progress in stages: cramps, heat exhaustion and heat stroke.

 

HEAT EXHAUSTION SIGNS INCLUDE:
? Cool, moist, pale skin
? Headache
? Dizziness and weakness or exhaustion
? Nausea

SIGNS OF THE LATE-STAGE HEAT STROKE INCLUDE:
? Vomiting
? Decreased alertness or loss of consciousness
? High body temperature (sometimes as high as 105 F.)
? Continued moist skin, or the victim may stop sweating and the skin may be red, hot and dry
? Rapid, weak pulse
? Rapid, shallow breathing

New Posting Requirement for Federal Contractors and Subcontractors

The U. S. Department of Labor has implemented a regulation requiring federal contractors and subcontractors to post a notice advising employees of their rights under the National Labor Relations Act (NLRA). The rule is effective June 21, 2010.

The regulation implements Executive Order 13496 issued by President Obama. The law reverses Executive Order 13201 (the Beck Notice) issued by the Bush Administration which required Federal Contractors to notify employees of their rights not to join unions.

Federal Contractors and Subcontractors are required to post the notice "Employee Rights Under the National Labor Relations Act" in facilities and offices where employees covered by the NLRA perform contract-related activity, including all places where notices to employees are customarily posted.

The notice informs employees of Federal Contractors and Subcontractors of their rights under the NLRA to organized and bargain collectively with their employers and to engage in other protected concerted activity. Additionally, the notice provides examples of illegal conduct by employers and unions, and it provides contact information to the National Labor Relations Board (NLRB), the agency responsible for enforcing the NLRA.

Because the rule broadly defines a "Government Contract" to also include agreements whereby the federal government obtains "fund depository services", the rule will apply to banks and credit unions that have Treasury Tax & Loan accounts with federal government agencies, which provide services related to U.S. savings bonds, or that have other types of government contracts. Accordingly, banks and credit unions that provide these services should post this new notice in addition to all other Federal Contractors.

From the West: Take the Loop 101 eastbound to Scottsdale. Exit at the Princess/Pima exit. Stay straight on frontage road to Bell Road. Turn left on Bell Road, and the Ice Den will be on the right.
